Terms and Conditions
Acceptance
All bookings accepted by Casa Mia are subject to these Terms and Conditions that are deemed to have been accepted in full by the Guest. Payment of a Booking Fee or Rental Charge also indicates acceptance of these Terms and Conditions.

General
Renting serviced units or accommodation from Casa Mia is not intended to confer possession on the Guest or to create the relationship of landlord and tenant between us and the Guest. The Guest will not be entitled to any form of tenancy. The Guest confirms that they will not be occupying the serviced unit as their only or principal home.

Reservations & Payment
Your booking is only confirmed when we post or email written confirmation of booking following receipt of payment of the Booking Fee. When a booking is made, 50% of the total Rental Charge (Booking Fee) is required within 48 hour or making the reservation in order to confirm the reservation. The balance (if any), of the Rental Charge is to be paid 30 days prior to the arrival date. If we do not receive full payment by this time, the reservation may be cancelled and the deposit forfeited. The Guest may be liable for the balance of the Rental Charge and for any other costs involved in the attempt to re-let the serviced unit. When a booking is made less than 30 days prior to the arrival date, the full Rental Charge is required to confirm the reservation. Guests wishing to extend their stay are required to give at least 7 days’ notice, subject to the room or an alternative being available. Payment must be made in South African Rand (ZAR) and must be clear of all bank charges, exchange rate variations and any other deductions.
We accept bank transfer to our account. Under no circumstances will accommodation be provided until we have received cleared funds to cover the Rental Charge. Failure to pay in accordance with the agreed terms of payment may result in suspension of accommodation. We reserve the right to charge interest on overdue accounts at the going interest rate per month or part thereof and to seek payment in full.

Cancellation Policy
Only written cancellations will be accepted, which will be acknowledged by our reservations office.
50% of the total payment is payable if the reservation is cancelled 7 to 14 days prior to arrival.
100% of the total payment is payable if the reservation is cancelled less than 7 days prior to arrival.
Should you not arrive on the date you have booked, and have not cancelled your booking in writing, you will be debited with a no-show fee of one night’s stay.
A change of arrival date or departure date by the Guest may be treated as cancellation and re- booking. Casa Mia recommends that the Guest insures against cancellation.

Arrivals & Departures
Rooms are available for occupation between 14h00 (2pm) and 18h00 (6pm) on the day of arrival, should you not be able to check-in during this time, please contact us to arrange a late-arrival check-in. Rooms must be vacated and keys returned by 10:30 on the day of departure.

Accommodation Charges
The nightly accommodation includes daily service of rooms and change of linen and towels at the discretion of management. Our minimum length of stay is 1 night, with no maximum.

Occupants
Only Guests specified by name at the time of booking by the Guest may occupy the rooms. The Guest must not assign, sublet or part with or share possession of the serviced unit or any part of it. Casa Mia reserves the right to refuse admittance to the Guest if they are in breach of this condition.

Keys
Keys will be provided for the serviced units and are to be returned in line with the departure terms as above. For any keys not returned, there will be a R100.00 charge. If the Guest loses or misplaces their keys during occupation and require assistance to gain entry, an additional charge of R100 will be made.

Property Use & Conditions
The Guest is responsible for taking all reasonable care of the serviced unit and its contents. The serviced unit and all equipment, utensils, furniture etc. must be left clean and tidy at the end of the Rental Period. No items may be removed from the serviced unit. Except in the case of normal wear and tear the Guest will be responsible for making good any damage to the serviced unit or its contents which has occurred due to negligence, willful damage or irresponsible behavior on the part of the Guest or their visitors. Such damage must be reported to us without delay. In the event that breakages or damage are discovered, or extra cleaning required, after departure, we will notify the Guest in writing within 7 days of departure, providing detail of the issues and an invoice for the cost of rectifying them. Casa Mia will not be held responsible for any personal injury, loss or damage to personal effects howsoever arising at the serviced unit or in the unit block or its grounds. Smoking is not permitted in the rooms or breakfast room. Smoking is permitted at our bar and pool area. Pets are not allowed.

Complaints
Any complaints must be made in writing immediately to Casa Mia. We shall not have any liability for any complaint received after the completion of the Rental Period.

Disclaimer & Indemnity
The following disclaimer must be signed by guests on arrival, this indemnity is recommended by the by the Tourism Grading Council of South Africa. In the case of a group of people a representative must sign the document for and on behalf of all members in the group.

“The Proprietor, its agent/s and/or its employee/s (“the Proprietor”) shall not be liable for, and the guest/s hereby waive/s and abandon/s any claims of whatever nature including but not limited to that for theft, injury, loss or damage of whatever nature, against the Proprietor, whether arising from the Proprietor’s default, negligence or otherwise.

The guest/s, in addition to the aforesaid, hereby indemnify the Proprietor against any claims which may arise from whatever nature, whether arising from the Proprietor’s default, negligence or otherwise.

Whilst every endeavour is made in terms of the above recommendation to provide for the exclusion of an innkeeper’s liability, such liability or exclusion thereof is never absolute and is always subject to a matter of degree and the application of an appropriate court’s discretion.

It should also be borne in mind that the court’s discretion is applied judicially but subject to the credibility and worthiness of appropriate evidence.

I agree that this indemnity is valid should I visit the guesthouse at a later date.”
